Rubbish Removal Marylebone Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Marylebone provides rubbish removal and waste collection services to residential and commercial customers. By booking a waste collection, you agree to be bound by these terms. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Service means the rubbish removal, waste collection, clearance and related services provided by Rubbish Removal Marylebone, including the loading, transportation and disposal or recycling of waste materials.
Customer means any individual, business, company, partnership or organisation that makes a booking for the Service.
Booking means a confirmed request by the Customer for the Service, whether made by telephone, email, online form or any other method accepted by us.
Waste means any rubbish, refuse, junk, debris, household items, commercial waste, garden waste, bulky items and other materials that the Customer asks us to remove, excluding any items that we are not permitted to handle under applicable law or regulation.
Site means the property, premises or location from which the waste is to be collected and any access routes reasonably required to perform the Service.
2. Scope of Service
Rubbish Removal Marylebone provides a professional rubbish removal and waste collection service which may include domestic clearances, commercial clearances, office clearances, garden waste removal and bulky item removal, subject to availability and compliance with waste regulations.
Unless expressly agreed in writing, the Service does not include cleaning of the Site, removal of fixtures or fittings attached to land or buildings, dismantling of structures, or any work that would require specialist equipment or additional permissions.
We reserve the right to refuse removal of any item that we believe cannot be safely handled, that may cause damage, that is prohibited waste, or that is not in line with these Terms and Conditions.
3. Booking Process
Customers may request a booking by telephone, email or through an online enquiry. At the time of enquiry, you should provide accurate details of the type and approximate volume or weight of waste, the Site address, access conditions, preferred date and time, and any other relevant information.
We may provide an estimated quote based on the information you supply. This estimate is not binding and may be revised when our team attends the Site and assesses the actual waste to be collected. A booking is only confirmed when we have accepted your request and provided a booking confirmation with the agreed date, time window and pricing basis.
We endeavour to attend all bookings within the agreed time window, but arrival times are approximate. We will not be liable for any losses arising from a delay or rescheduling caused by traffic, weather, operational issues or circumstances beyond our reasonable control. Where practicable, we will notify you of any significant changes to your booked time.
4. Customer Obligations
The Customer is responsible for ensuring that:
All information provided at the time of booking is accurate, complete and not misleading.
Suitable access is available to the Site for our vehicles and staff, including any arrangements required for parking, loading and unloading.
Any required permissions, permits or authorisations for vehicle access or waste removal from the Site are obtained in advance, unless we have expressly agreed to arrange them.
Waste is presented safely and, where agreed, is reasonably accessible and ready for collection at the time of our arrival.
The Site is safe for our team to work at, including stable flooring, adequate lighting and absence of risks not previously disclosed.
If we are unable to complete the Service because of incorrect information, inadequate access, health and safety concerns or failure to obtain necessary permissions, we may charge a call-out fee or apply our cancellation terms below.
5. Pricing and Quotes
Our pricing for rubbish removal services may be based on factors including, but not limited to, the volume of waste, weight, type of materials, labour time, access difficulty and disposal or recycling fees. We may provide an indicative estimate at the time of booking, which is subject to confirmation after our team has inspected the waste on Site.
If, upon arrival, the actual waste or conditions differ from the information provided at booking, we may revise the price. Where the revised price is higher than the original estimate, you will be informed before we start work. If you decline the revised price, we reserve the right to charge a reasonable call-out or cancellation fee to cover attendance and operational costs.
All prices are quoted in pounds sterling and may be inclusive or exclusive of VAT depending on our registration status and the nature of the Service. Any applicable taxes or fees will be disclosed to you before you agree to proceed.
6. Payments and Invoicing
Payment is due in full on completion of the Service, unless we have agreed alternative payment terms in writing before the booking. We may accept payment by cash, debit card, credit card, bank transfer or other methods disclosed at the time of booking or on our invoice.
For commercial Customers, we may at our discretion offer invoicing with specified payment terms. Invoices must be paid in full by the due date shown. We reserve the right to charge interest on late payments at the statutory rate permitted under applicable law, accruing on a daily basis until payment is received in full.
We may refuse to commence or continue the Service where payment is not made as agreed, or where we reasonably believe that payment will not be made. Title to any collected waste transfers to us only upon full payment of the agreed charges, subject to compliance with waste regulations.
7. Cancellations and Rescheduling
The Customer may cancel or reschedule a booking by giving us as much notice as possible. Where at least 24 hours notice is provided prior to the scheduled arrival time, no cancellation fee will usually apply.
If you cancel with less than 24 hours notice, or if we are unable to complete the Service due to reasons within your control, including lack of access, incorrect information or failure to be present where required, we reserve the right to charge a cancellation or call-out fee to cover our reasonable costs.
We may cancel or reschedule a booking at any time if we are unable to perform the Service due to circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, safety concerns or legal restrictions. In such cases, any amounts paid in advance for the affected Service will be refunded or applied to a rebooked appointment, and this will be your sole remedy.
8. Waste Types and Restrictions
Rubbish Removal Marylebone operates in compliance with UK waste management and environmental regulations. We are not permitted to collect or transport certain hazardous or controlled wastes, such as asbestos, clinical waste, medical sharps, chemicals, solvents, gas bottles, pressurised containers, large quantities of paint, oil, tyres or any other materials that we notify you are not accepted.
You must inform us at the time of booking of any potentially hazardous materials, sharp objects, heavy items or restricted items that you wish us to remove. If we discover such items on arrival that were not disclosed, we may refuse to remove them and may revise the Service price or cancel the booking.
We will dispose of or recycle collected waste at licensed facilities only. We aim to minimise landfill where practicable by separating recyclable materials, reusing items and using authorised recycling centres. However, no guarantee is given that any particular item will be recycled or reused.
9. Access, Parking and Permissions
The Customer must ensure that suitable access and parking are available at or close to the Site for our vehicles for the duration of the Service. This may involve arranging parking permits, visitor passes or entry codes, and ensuring that driveways or access roads are clear.
Any parking fees, fines or penalties incurred because you have not provided suitable parking arrangements or accurate information may be added to your final bill. Where there are restrictions on vehicle size, loading times or stopping, you must inform us in advance.
If access to certain areas of the Site requires permission from a landlord, managing agent, local authority or other third party, it is your responsibility to obtain such permission unless we have expressly agreed otherwise in writing.
10. Health and Safety
We take health and safety seriously and will perform the Service with reasonable care and skill. Our team members may decide not to proceed with any aspect of the Service if they consider it unsafe to do so, including where there are structural issues, hazardous materials, aggressive behaviour, or environmental risks.
You agree to co-operate with our team on Site, to follow any reasonable safety instructions given and to keep children, pets and other individuals away from working areas during the Service.
11. Liability and Limitations
We will exercise reasonable care and skill in providing the Service. If we fail to comply with these Terms and Conditions, we are responsible for any foreseeable loss or damage you suffer as a direct result of our breach or negligence, up to the limits set out below.
Our total liability to you in respect of any claims arising out of or in connection with the Service, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall not exceed the total price paid or payable by you for the specific Service giving rise to the claim.
We will not be liable for loss of profits, loss of business, loss of goodwill, loss of data, or any indirect, consequential or special losses. Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under UK law.
You are responsible for removing or securing any fragile items, valuables or personal possessions that may be affected by the clearance work. We are not liable for normal wear and tear, minor scuffs, or damage to items left in or around waste, unless caused by our negligence and clearly evidenced.
12. Complaints and Disputes
If you are unhappy with any aspect of the Service, you should contact us as soon as possible, providing your booking details and a clear description of the issue. We will investigate your complaint and, where appropriate, may offer a remedy such as a partial refund, re-performance of part of the Service, or another solution agreed with you.
Any dispute arising out of or in connection with these Terms and Conditions that cannot be resolved through our internal complaints process may be referred to mediation or other alternative dispute resolution by mutual agreement.
13. Personal Data
We may collect and use personal data such as your name, contact details, address and payment information for the purposes of managing bookings, providing services, processing payments and complying with legal obligations. We will handle your personal data in accordance with applicable data protection legislation and keep it secure and confidential.
14. Amendments to Terms
We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our operations or industry practice. The version in force at the time of your booking will apply to your Service. Updated terms may be made available on request.
15. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales will have exclusive jurisdiction over any dispute or claim relating to these Terms and Conditions or the Service, subject to any mandatory rights you may have as a consumer to bring proceedings in another jurisdiction.
By placing a booking with Rubbish Removal Marylebone, you confirm that you have read, understood and agree to these Terms and Conditions.
